License Agreement
This page outlines the licensing agreement between CacheHeap, LLC the end-user of any of its software, products, or services. By using any of CacheHeap, LLC's offerings, you agree to be bound by the terms and conditions outlined in this agreement.
1. Definition of Terms
"Software" refers to any software products developed and offered by CacheHeap, LLC, including but not limited to desktop applications, mobile applications, web applications, and server-side software.
"Products" refers to any physical or tangible products developed and offered by CacheHeap, LLC, including but not limited to hardware components and accessories.
"Services" refers to any services offered by CacheHeap, LLC, including but not limited to cloud computing services, consulting services, and support services.
2. License Grant
CacheHeap, LLC grants the end-user a non-exclusive, non-transferable license to use the Software, Products, and Services solely for personal or commercial use, as long as the end-user complies with all terms and conditions outlined in this agreement.
3. Restrictions on Use
The end-user agrees to not reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software.
The end-user agrees to not modify, adapt, or create derivative works based on the Software, Products, or Services offered by CacheHeap, LLC.
The end-user agrees to not redistribute, resell, or sublicense the Software, Products, or Services offered by CacheHeap, LLC without the prior written consent of CacheHeap, LLC.
4. Ownership and Intellectual Property
CacheHeap, LLC retains all right, title, and interest in and to the Software, Products, and Services, including all intellectual property rights therein.
The end-user agrees that the use of the Software, Products, and Services is limited to the terms and conditions outlined in this agreement, and that no ownership rights are transferred to the end-user.
5. Disclaimer of Warranties
The software, products, and services are provided “as is”, without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the software, including without limitation the warranties of merchantability or fitness for a particular purpose, and non-infringement. Specifically, cacheheap, LLC does not warrant that the software, products, or services will be error-free or will meet any particular criteria of performance or quality.
6. Limitation of Liability
Cacheheap, LLC will not be liable for any damages, including without limitation, direct, indirect, incidental, or consequential damages, whether in an action of contract, negligence, or other tortious action, arising out of your use of the software, products, or services, or for any other claim related in any way to your use of the software, products, or services, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred.
